    Considering that the evidence in this case was stolen, i.e. unlawfully acquired, I wonder if the Spanish courts will consider it admissible?

      Probably because the morals of a person who steals are superior to those of a pedophile. The child molesters getting killed in prison IS the honor among the thieves.

    Who steals a super 8 camera in this day and age? I have to wonder if the burglar didn't know about the tapes and that's what they were really after, with the intent of turning them over to police.

      I imagine some people would still shoot stuff on Super 8 today, the way some people would still type manuscripts on an Olivetti.

      A small market, to be sure. But one that might be willing to pay premium for an item that's relatively rare.

      While it was about a decade ago, my son was really into Super 8 media. Since Super 8 is so odd to see these days, they may not have even known what it was, but thought it looked like something they could determine and keep or trash later.

    I see they still want to catch the burglar. You know, how about he gets a pass this time? And not just because he did something good but because he now has to live with what he saw on those tapes for the rest of his life. That's punishment enough. Or, at least, it would be for me. Many times over.

      There's also the fact that it might not be his first time. What if this house was number 7, and yours was number 6. Do you still want him to get a free pass? Even though he just pawned your wife's engagement ring? (Ok, I'm playing up to your emotions now— but still).

    I thought that unlawfully obtained evidence laws applied only to police. 4th amendment wouldn't cover this so it should be admissible. Either way the guy is already guilty in the eyes of the public.

      You realize that none of your argument applies here, right? This didn't happen in the US, but in Spain. And while I am certain that Spanish citizens have rights, I doubt that those rights match those enjoyed by Americans.

      The Spanish constitution was ratified post-Franco, so actually, in its modernity and its eagerness to wipe out the repressive police state, it is more liberal than the US constitution (and no guns). The main difference is that the US judicial system is based on the British (12 person jury), whereas, the Spanish judicial system is all about he Judge overseeing each case.

      This happened not too long ago to a guy who stole a cell phone. He found child porn on the creepy owner's phone.
