    Why is "activist judge" a dirty word? I understand the part about needing to be objective, but if it weren't for judges living in the present tense instead of "the good ole days" we would be in even worse shape.

    If you are disappointed that a judge is attempting to override the will of the people in this instance, you should be more disappointed in your people, not the judge.

      Activist judge is a dirty word because it represents a judge who influences laws that Congress at the state and national level are supposed to write. The same judges that tried to tell us that white only water fountains were permissible.

    It's funny how we all when "activist" judges rule against our personal beliefs we hate them (like allowing extraordinary rendition or calling corporations "persons" for free speech purposes), but when they rule in favor of our personal beliefs, we love them (like the judge in Utah). Maybe, just maybe, there is no such thing as an activist judge.

      Because "activist judge" — like "tax payers (dollars)", "climate change", "death tax" and "welfare reform" - is a cynical, thought-terminating cliche cooked up by rightwing think tanks and PR hacks in the nineties as part of a well-funded and coordinated effort to corrupt political language in their favor.

    People's rights stop at point of trampling over other peoples rights. If those people are soo against the rights of others, be they gay, transgender, w/e, then go find a country that oppresses those people. The US isn't supposed to be one of those places. That includes Utah, that's why our slogan is: the land of the free. Not the: Land of making everyone believe and suffer by whatever we say... (Such as religious tyranny)

    Thats why we left England you know... Not that we're that good at learning from history.

      But the people of Utah don't have a right to same sex marriage. It's not in their state constitution and it's not in our national constitution. They also never voted to permit it. If it was a right then all laws banning its practice would be null and void, hence the AG's comments.

      All people have the right to equality though. Which includes same sex marriages, by simple definition that straight people have the right to marry. By denying it, it's denying those rights to equal treatment, so imo, it is illegal on those grounds.

      Nope.

      The outrage over a court striking down laws to protect a social minority in their attempt to gain equal standing on non-traditional marriage is especially... um... fascinating... given that Utah's history is inexorably linked to conflict over differing views on marriage. More specifically, the desire of Utah residents to have the Federal government recognize unions of which the mainstream didn't necessarily approve.

      For Utah of all states to assert that the majority should dictate the marriage habits of the minority is a little crazy. To position themselves as arbiters of "traditional marriage" is absurd in a truly special way.

      So no, that doesn't mean I believe everyone in Utah has 34 wives.
