    Fair enough, fair enough. Keep an eye on this kind of language, however: "the dignity of these same-sex COUPLES."

    Our civilization has developed, quite beneficially I think, the idea of marriage as a love-match between a couple exclusively — forsaking all others. So if two gay people want to declare their intention for a life-long commitment to each other, I see no reason why we shouldn't let them enter into a marriage fully recognized in law. It hurts no-one.

    But then, we had that OTHER decision vis-a-vis Utah recently — which struck down an anti-polygamy statute. Now as best I understand, that decision was related to authorities using co-habitation rather than actual marriage to prosecute polygamists, so it's not like we're suddenly going to legalize polygamy all over. But the waves of ahistorical ostrich-like head-in-the-sand SUPPORT for legalized polygamy that washed over comments all over the internet was kinda concerning.

    I find it sadly ironic that gay marriage has gained so much support based upon the great value we place upon the modern couple marriage, but that far too many of the same people are ready to throw the modern couple marriage under the bus and to make a great leap backwards in history to legalized polygamy.

      I don't support gay marriage because I value on "the modern couple", whatever the hell that means. I favor one set of rules for everyone. You know, equality.

      I also have zero problems with polygamy. Consenting adults, and all that. Spare us the pearl clutching and value judgements.

      You have zero problems with the idea of polygamy you've invented in your head that has no relation to actual polygamy practices. Children being sold into relationships with ancient patriarchs, women stripped of even of the barest notions of equality or autonomy. THAT is how polygamy is actually practiced in America and abroad. It's not the TV friendly OH WE JUST HAVE LOVE FOR MORE THAN ONE PERSON hippy dippy stuff.

    Wow... So we have New Mexico legalizing same sex marriage this week followed by Utah's ban being overturned. Utah, one of the staunchest opponents to same-sex marriage (so staunch that citizens in the state provided nearly 45 percent of the funding in favor of Proposition 8 in California), no longer has a ban on same sex marriage. When did we cross back over into a not so dark timeline?

      Whoa. Slow down there, sparky. One federal judge declaring this to be unconstitutional does not necessarily change much, and the outright ban being struck down is not necessarily the same as allowing same-sex marriages to take place. Several states have no ban, but nevertheless do not allow same-sex marriage. The bans are really just symbolic. Utah wanted the whole world to know that they are super hardcore about stickin' it to those uppity gays. Most of the time the constitutions and/or laws of ban states were already pretty clear on this matter.

      State governments can and often do completely ignore the rulings of district judges for as long as they possibly can. What the circuit appeals court has to say on the matter will be far more impactful, and could possibly affect all the states in its jurisdiction depending on the language of the ruling. Utah will be counting on them to reverse or at least stay this move so that they can fight it for several years all the way up to the Supreme Court (if possible).

      I personally hope the Supremes strike down not only all bans like this, but any and all statutes whatsoever that disallow gay marriage. I've heard that isn't likely because they would rather let Congress deal with it, but I'm hopeful nonetheless.

      Same sex marriages are already taking place in Salt Lake City (where lots of lgbt people live). Unlike other federal court decisions recently, this one has no stay on its effect. And the state will probably have trouble coming up with a reason to get one - they will have to prove some emergency reason why the marriages should stop. Most appeals courts will have a much harder time justifying the stop of a stopping a process that's already underway.

      It's worth noting that Utah and New Mexico are both under the 10th Circuit Court of Appeals, so that's promising (they're pretty reasonable as the circuits go; old western live-and-let live rooted mentality).

    I wonder if the new rules regarding judicial nomination will make this new paradigm emerge faster. It certainly seems the consensus of educated people under thirty that a free and equal country is not compatible with limited rights for LGBT citizens.
