      That's really what it comes down to, isn't it? There are so many people who will fervently defend behavior that is absolutely, positively sexual and nonconsensual. It's really a sign that they resent women having any right to withhold consent in the first place, so if there's any way around it legally than the perpetrator deserves kudos for being so resourceful.

      I get the frustration, but they're the views of this guy, not necessarily the views of his lawyer. He has just as much of a right to have his repugnant arguments presented well in a court of law as anyone else. If the court agrees with her, it's because the current law is written poorly, not because the defendant did nothing wrong.

      What I'm saying is I sympathize. In my nightmares, I have to take a case like this and make these sorts of arguments with my name attached to them. (Since these are nightmares, it usually happens when I've forgotten to prepare and I've showed up to oral argument in my underwear.)

      I assume it has something to do with the fact that she likes money. Being an attorney doesn't always mean it's about morals, or pride. It often means trudging from one case to the next, you only look at the law in a vacuum, and you work for those billable hours.

    I'm gonna be nitpicky, but if he's being tried on criminal charges then I don't think the headline, that he's suing, is correct.

    As for this nonsense about no right to privacy under my skirt, if the cops would need reasonable to cause to lift up my skirt to see if I have drugs taped to my thigh (which I assume they do) than this guy doesn't have a right to take photos of the same area.

    Legal experts, please correct me if I'm wrong on either point.

      You're correct. He wasn't "suing" for anything, he was arguing some sort of interlocutory appeal in a criminal proceeding. Totally. Different. Things.

      And since I'm fired up, calling his attorney a traitor to womanty is at best irresponsible and at worst, really fucking offensive (says the former public defender). I do tend to roll with Jez's satirical humor and I get it was a "funny" quip but that one stung.

      And while repugnant, the argument is legally valid as a challenge to a potentially vague statute on a constitutional rights issue. As defense counsel, you have to decide whether that repugnancy is worth it and you have to be really strategic about it if you go forward. But a lot of times it's required to provide zealous representation. I'm not offended by how this was argued from a legal standpoint. I'm not saying one way or another whether this asshole should get relief in his case but engaging in this type of appellate process is a benefit of living in a democracy with a robust (if totally imperfect) criminal justice system.

      Thank you for pointing this out. The headline is totally misleading, and you don't need to be a legal expert to know it. I clicked the article because the headline immediately made me think, "That can't be right," but I was still shocked to see how many people are getting worked up over it. This isn't a Hot Coffee situation, you are allowed to defend yourself when the government threatens your liberty.

      Whether it is morally reprehensible to make the argument is a legitimate debate. But twisting the facts so that the pervert is also aggressively seeking a court order allowing him to snap upskirts doesn't add to that debate.

    Why did the attorney 'betray womanity' by simply doing the job she must do by law? As much as this guy is a scumbag, the attorney that defends him must do so to the best of his or her ability, even if she too thinks in private that the guy deserves to rot in jail for what he has done.

    I think its unfair to call her a traitor.

      If this is a criminal case and she was court-appointed, I'd agree with you, although her "defense" goes so far beyond the pale it negates the point that she was assigned to the case. If she's a private lawyer and didn't HAVE to take the case (whether criminal or civil), traitor. Traitor traitor traitor.

      It appears to be a criminal case since he was breaking a law and he was caught by the police. And no, just because the defense is crazy, it does not negate the fact that she was assigned to the case. If she has good reason to believe that this kind of defense will actually work, it is her duty as a lawyer to take this route. She is simply being a professional.

      Also even if she wasn't assigned to the case, work is work. If you are a lawyer you might not have the luxury of turning down clients just like that. And even if this women is a super successful lawyer who can pick cases on the basis of personal preference because everyone wants her as their lawyer, our justice system is based on giving the defendant the right to defend him or herself. The western justice system is the best in the world exactly because it gives douchebags like this guy a chance to defend themselves, even though they do not deserve it. Hell, we even give dictators and mass murderers the chance of a good defense in court. That is what makes us better than all those other places where justice is ruled by either a mob mentality or where it are politicians who decide whether you are guilty or innocent. The lawyers that defended the Nazi officials or scumbags like Milosovich are not traitors to humanity either simply because they defend bad people.

      Aside from that, it isn't mentioned whether she was assigned to this guy or not. So this article does judge her without knowing all the facts, or at least without telling us all the facts. I find that if you call someone a traitor to roughly 50% of the worlds population you better have a damned good reason for it.
