    Pfft! There's such a thing as asymptomatic shedding (of the virus), which can happen outside the condom area, plus you can have the virus for years without having outbreaks. I don't see how she can prove that he knowingly gave her the virus.

    Hope she gets it. Men are negligent enough about getting tested for STDs (yeah, it's true). As long as STDs don't manifest themselves clearly or aren't overt problems for men, they don't seem to give a fuck. I have ended friendships with men for refusing to share that they're probable carriers for HPV for their sexual partners, because clearly ovarian cancer is NBD to them.
    Just because you're irresponsible doesn't mean you should lie about that shit. If you've fucked a partner that has revealed having an STD to you, you owe it to others to show the same respect.

    Seriously no one has any sense of personal responsibility anymore? She decided to take someone at their word that to their knowledge they do not have any sexually transmitted diseases. SHE MADE THAT DECISION. Yet she now expects him to pay her 5 million dollars for her choice.

    Points of note:
    - A condom will only prevent herpes transmission from a man to his partner if the outbreak or viral shedding is occuring on the penis. Herpes can occur anywhere in the genital area, so a condom is not necessarily prevention from herpes transmission. Therefore,
    - He should have told her about his history with herpes before they had sex at all. But,
    - She could have been exposed at pretty much any time in her (sexually active) life and her outbreak could have been entirely coincidental to their having unprotected sex, and brought on by stress or any number of factors.
    - There's absolutely no way to correlate her herpes to his. But he still should have told her before they ever had sex.

      Point 1 - true.

      Point 2 - true.

      Point 3 - False. She is claiming in her filing that her initial test showed no antibodies to HSV2. This correlates to a new infection.

      Point 4 - False. The antibody test is one correlation. A viral DNA can also be done to determine if they have the same strain. Finally, if there are previous partners who are either infected (for him) or not infected (for her), it is again circumstantial evidence of the truth of her claim.

    Any time this topic comes up, I'm reminded of this:

    Early 20th century public health legislation in the United Kingdom required compulsory treatment for sexually transmitted diseases but did not include herpes because it was not serious enough. As late as the 1975, nursing textbooks did not include herpes as it was considered no worse than a common cold. After the development of acyclovir in the 1970s, the drug company Burroughs Wellcome launched an extensive marketing campaign that publicized the illness, including creating victim's support groups.

    Not really sure what to say, as I wouldn't want it anymore than anyone else, but it sort of amazes me how something once considered ordinary can be turned into a terrifying pathology once corporations get involved.

      It's really not that big a deal for most people after the initial outbreak, and it is very treatable but yeah, stigma and all that. According to the CDC HSV-1 has a 60% incidence in America but you don't see people freaking out over that.

      Indeed, they made into the stigma it is to sell their drugs. Sort of like the scary "shingles" tv ad currently in circulation: "If you had chicken pox as a child, the virus is already inside of you!" OMFG! They want to sell their $200-a-pop vaccine.

          Here is how I know her story is BS. She claims in March 2012 they had their first unprotected experience. Days later she already had an outbreak. Herpes does not manifest that quickly. It takes between 3 weeks and 6 months for the initial outbreak. She obviously was fooling around with someone else and had an outbreak from that, not this guy.

            Wrong. Symptoms can start to appear within a few days of exposure to herpes.

            It's 3 weeks to 6 months for HPV.
